Below are transcriptions of deeds concerning four generations of my CARPENTER ancestors (in which Seth Prime CARPENTER figures prominently) in Upton and Milford, Worcester County, Massachusetts, between 1827 and 1889.

In the recording process someone in the Registry office took care to underline misspellings and inconsistencies (which I've rendered with a [sic]) and also inserted a "-^" wherever there's an omission. I have omitted any superscription used in abbreviations. My editorial comments are enclosed in square brackets. The date range I've specified refers to date of signature, not recording.

The punctuation is likely incorrect. Commas and periods look very much alike in the images, the copyist may have omitted punctuation in the interest of speed, and there may be microfilm artifacts appearing. In addition, I have played fast and loose — for the life of me I can't bear to see a middle initial without a period. If this casts doubt on the accuracy of my transcriptions, by all means look at the original images at Massachusetts Registry of Deeds. The more pairs of eyes the better.

The Properties

This is only a small selection of the transactions that Seth P. Carpenter was involved in — better than 100 in the 1840-1889 grantor and grantee indexes alone. My initial strategy was to transcribe some of the earliest and latest documents. The two obvious groupings concern his father's farm, and then all the rest. For the time being the "all the rest" category is ordered chronologically; it may make sense later, with more deeds being transcribed, to group them differently. Documents concerning his Uxbridge trout farm are on another page.

Upton Farm

These documents show the disposition of Reuben Carpenter's Upton farm. The deeds describe it as being in Upton and Milford while the map shows it only as abutting Milford. I believe the border was at this time stable; perhaps this was a lawyerly precaution to account for imprecision in surveying or describing the land.

Reuben died in 1802, willing the farm to his eight living children (Lydia, Welcome, Reuben, Elisha, Sally, George Washingtion, Abner Palmer, Seth Prime). His second wife, Hannah Cook (mother of Abner Palmer and Seth Prime), occupied it by her right of dower until her death in 1842, when it passed to the heirs or their assigns. Three of the original eight shares passed from the original inheritors to others: Elisha and Welcome apparently disposed of their interests (they're not mentioned in the deeds below, but I didn't check for their appearance in the indexes), and Reuben mortgaged his to George and did not redeem it.

Milford Properties

These documents describe some of Seth P. Carpenter's dealings in Milford. It's interesting to see that his mother-in-law, Nancy Barber, held one of his mortgages, and that he went bankrupt in 1846.

The Deeds

Reuben Carpenter to George W. Carpenter, 1827

Know all men by these presents that I Reuben Carpenter of Glanville [sic, Glenville] County Schenectady State of New York do for the sum of one hundred and fifty dollars in cash recd. of George W. Carpenter of Shelburne County of Franklin State of Mass. do hereby grant sell and relinquish my right and title which I now hold in the estate of my father who is deceased it being the thirds of Hannah Carpenter whereon she now lives, it being in Upton County -^ Worcester State of Mass. I the said Reuben do bind myself, my heirs and assigns forever to release the same unto the said George his heirs and assigns unless I the said Reuben do pay the said George the sum above mentioned with legal interest for the same, then this obligation to be void or otherwise to remain in full force and virtue.

In witness whereof I have set my hand and seal this 10th day of Oct. 1827.

Know all men by these presents that we Elijah Warren of Upton & Lydia wife of the said Elijah [sic] -^ Brainerd Fiske of Upton Elisha Taft of Worcester & Sally wife of the said Elisha all in the County of Worcester George W. Carpenter of Shelburne in the County of Franklin & Abner P. Carpenter of said Upton do by these presents make constitute and appoint Seth P. Carpenter of Milford in said County of Worcester our lawful attorney for us & each of us & in our names to grant sell & convey by good & sufficient deed or deeds with the usual covenants of warranty each covenanting for himself only & not for each other all of our [s-- ?] respective interests & estate in & unto about fifty acres of land lying partly in Upton & partly in Milford aforesaid with the building thereon being all the land which was set to Hannah Carpenter lately deceased as her dower in the estate of her late husband Reuben Carpenter deceased & the same which she formerly occupied for a description thereof reference is had to the assignment of Dower aforesaid recorded in the registry of Probate in the county of Worcester the interest therein of each of the parties aforesaid being [as follows ?] the said E[lijah & Lydia?] [?] owners of one eight part thereof in her right the said Brainerd being the owner of one eight part the said Elisha & Sally being the owners of one eight part in her right the said George W. Elijah Warren, et al to Hartford Stoddard, Upton 1842

Know all men by these presents that we Elijah Warren of Upton & Lydia wife of the said Elijah David B. Fiske of Upton Elisha Taft of Worcester & Sally wife of the said Elisha all in the County of Worcester George W. Carpenter of Shelburne in the county of Franklin Abner P. Carpenter of said Upton Seth P. Carpenter of Milford in the County of Worcester & Orton [sic] Pease whose residence is not now known in consideration of Four hundred & twenty eight Dollars to us paid by Hartford Stoddard of Upton in the County of Worcester the receipt whereof is hereby acknowledged do hereby give grant bargain sell & convey unto the said Hartford Stoddard his heirs & assigns certain tracts of land consisting of about fifty acres more or less lying partly in Milford & partly in Upton aforesaid with the buildings thereon being all the land which was set to Hannah Carpenter lately deceased as her dower in the estate of her late husband Reuben Carpenter deceased & the same which she formerly occupied for a description of which reference is had to the assignment of Dower aforesaid recorded in the registry of probate in the County of Worcester Book 31 & pages 504, 505 & 506 we severally conveying the following proportions of said land to wit the said Elisha & Lydia one eighth part thereof in her right the said David one eighth part the said Elisha & Sally one eighth part in her right the said George W. Carpenter two eighth parts the said Abner Carpenter one eighth part the said Seth P. Carpenter one eighth part the said Pease one eighth part the whole being now in common & undivided with all the privileges & appurtenances thereto belonging.

To have and to hold the aforegranted premises to the said Hartford Stoddard his heirs & assigns forever. And we the aforementioned grantors do covenant each for himself his heirs Executors administrators & not for the others with the said Hartford Stoddard his heirs & assigns that we are lawfully seized in fee in the aforesaid proportions of the aforegranted premises that they are free from all incumbrances that we have good right to sell & convey the same to the said Hartford Stoddard as aforesaid & that we will warrant and defend the same to the said Hartford Stoddard his heirs & assigns forever against the lawful claims and demands of all persons.

Sullivan Sumner to Seth P. Carpenter, Milford 1844

Know all men by these presents that I Sullivan Sumner of Milford in the County of Worcester and Commonwealth of Massachusetts Esquire in consideration of one hundred fifty three dollars sixty one cents paid by Seth P. Carpenter of the same Milford Bootmaker the receipt whereof I do hereby acknowledge do hereby give grant sell and convey unto the said Seth P. Carpenter his heirs and assigns a piece of land situated near the center of said town of Milford containing sixty six and an half square rods bounded beginning at a post at the Southwesterly corner of the piece it being at a corner of John Erskine's land and on the Westerly side of the road leading from the Universalist meeting house to the North Purchase then Northerly and bounding Easterly by said road six rods to the Widow Newton's land then South sixty seven & one third dgs. West & bounding by said Newton's land ten rods to a stake and stones at the old purchase road then Southerly and bounding Westerly by the last mentioned road five rods nine links to a stake and stones at Artemus B. Vant's land then North eighty two and an half dgs. East by said Vant's land four rods twenty two links to a post at said Erskine's land then North sixty seven & one third dgs. East, by said Erskine's land eight rods to the place of beginning.

To have and to hold the aforegranted premises to the said Seth P. Carpenter his heirs and assigns to his & their use and behoof forever and I do for myself my heirs executors and administrators covenant with the said Seth P. Carpenter his heirs and assigns that I am lawfully seized in fee of the aforegranted premises that they are free of all incumbrances except said Carpenter is to build the fence upon the whole length of the line on the North side next to the said Newton's land, that I have good right to sell and convey the same to the said Seth P. Carpenter and that I will warrant and defend the same premises to the said Seth P. Carpenter his heirs and assigns forever against the lawful claims and demands of all persons.

Seth P. Carpenter to Thaddeus Lovering, Milford 1844

Know all men by these presents that I Seth P. Carpenter of Milford in the County of Worcester and Comanwelth [sic] of Massachusetts Boot manufacturer in consideration of three hundred and seventy five dollars paid by Thaddeus Lovering of Medway in the County of Norfolk and Commonwealth aforesaid the receipt whereof I do hereby acknowledge do give grant sell and convey unto the said Thaddeus Lovering a certes [sic] house and tract or parcel of land lying in the centerly [sic] part of Milford in the County of Worcester containing sixty six and one half square rods bounded beginning at a post at the Southeasterly corner of the piece it being at the corner of John Erskine's land and on the Westerly side of the road leading from the Universalist meeting house to the North purchase then Northerly and bounding Easterly by said road six rods to the Widow Nuton's [sic] land then South sixty seven and one third degs. To have and to hold the aforegranted premises to the said Thaddeus Lovring [sic] his heirs and assigns to his & their use and behoof forever and I do for myself my heirs executors and administrators covenant with the said Thaddeus Lovering his heirs and assigns that I am lawfully seized in fee of the aforegranted premises that they are free of all incumbrances that I have good right to sell and convey the same to the said Thaddeus Lovering and that I will warrant and defend the same premises to the said -^ heirs and assigns forever against the lawful claims and demands of all persons.

Provided nevertheless that if the said Seth P. Carpenter his heirs executors or administrators pay to the said Thaddeus Lovering his heirs executors administrators or assigns the sum of three hundred and seventy five dollars [sic] then this deed as also a certain note bearing date with these presents given by the said Seth P. Carpenter to the said Thaddeus Lovering to pay the same sum in four months at the time aforesaid shall all be void otherwise shall remain in full force.

Seth P. Carpenter to Nancy Barber, Milford 1845

Know all men by these presents, that I, Seth P. Carpenter, of Milford, in the County in the County of Worcester and State of Massachusetts, Boot Manufacturer, in consideration of eleven hundred and fifty dollars, thirteen cents, paid to me by Nancy Barber, of the same Milford, the receipt whereof I do hereby acknowledge, do hereby grant sell, and quit claim, unto the said Nancy Barber, her heirs and assigns, all the right, title, claim, and demand, in and unto a certain house and land situated near the center of said town of Milford, containing sixty six and one half square rods, bounded: Beginning at a post at the Southwesterly corner of the piece, it being at a corner of John Erskin's [sic] land, and on the Westerly side of the road leading from the Universalist Meeting House to the North Purchase, then Northerly and bounding Easterly by said road six rods to the widow Newton's land: then South sixty seven & one third dgs. Seth P. Carpenter to Henry Chapin, Milford 1846

To all men to whom these presents shall come Henry Chapin of Worcester in the County of Worcester and Commonwealth of Massachusetts Esquire a Master in Chancery in and for the said County of Worcester sends Greeting. Whereas a warrant has been duly issued by me against the estate of Seth P. Carpenter of Milford in the County aforesaid Boot manufacturer as an insolvent debtor which warrant was returnable on the twenty ninth day of December in the year one thousand eight hundred and forty six and a meeting of the creditors of the said Seth P. Carpenter has been this day held in pursuance of the said Warrant and of the public notice given as therein ordered at which meeting John M. Wales of said Milford Gentleman was duly chosen assignee of the estate of the said Seth P. Carpenter. Now know ye that I the said Henry Chapin by virtue of the power and authority vested in me by reason of the premises do hereby convey assign transfer and set over to the said John M. Wales all the estate real and personal of the said Seth P. Carpenter including all such estate of which he was possessed or which he was interested in or entitled to on the second day of December current excepting such parts thereof as have been or shall be left in his hands as being by law exempted from attachment and all debts then due to the said Seth P. Carpenter with all liens and securities for such debts and all his the said Seth P. Carpenter's right of action for any goods or estate real or personal and all his right of redeeming any such goods or estate and all other the property effects rights and interests whatsoever of him the said Seth P. Carpenter which are or ought to be by law vested in him the said John M. Wales as assignee as aforesaid.

To have and to hold all such part of the assigned premises as is of the nature of real estate to him the said John M. Wales and to his heirs and assigns forever and all such parts of the same premises as is of the nature of personal estate to him the said John M. Wales and his executors administrators and assigns in trust nevertheless for the use and benefit of all the creditors of the said Seth P. Carpenter who have or shall appear as creditors and prove their debts in the proceedings under the aforesaid warrant and in trust that he the said John M. Wales shall use his best endeavors to recover and [secure?] all the estate debts and effects whatsoever assigned or [intended?] to be assigned as aforesaid and that he shall manage dispose of and account for the same and the proceeds thereof according to law and shall [shall?] at such times as shall be hereafter legally [be?] appointed in that behalf pay [?] and distribute what shall remain of the said estate in his hands after all just and lawful allowances to and among the creditors of the said Seth P. Carpenter who shall prove their debts as aforesaid.

Know all men by these presents, that I Seth P. Carpenter -^ Milford in the County of Worcester and Commonwealth of Massachusetts, Boot Manufacturer, in consideration of two hundred and eighty seven 00/100 dollars paid by Joseph C. Hubberd [sic] of the same Milford, Boot treer, the receipt whereof I do hereby acknowledge, do hereby give, grant, sell and convey unto the said Joseph C. Hubbard heirs and assigns, a certain house lot situated on a new street leading from main street to the Boston and Worcester Rail Road depot leaving main street between the house of Samuel Day and the late Col. Luis [sic] Jonson [sic] house known as the lane commencing at the westerly corner of said lot or about eight rods and four feet esterly [sic] of land of the lait [sic] Col. To have and to hold the afore granted premises to the said Joseph C. Hubberd [sic] his heirs and assigns, to his and their use and behoof forever. And I do for myself my heirs, executors, and administrators, covenant with the said Joseph C. Hubberd [sic] his heirs and assigns, that I am lawfully seized in fee of the afore granted premises: that they are free of all incumbrances: except a certain mortgage to Thaddeus Lovering of Medway which I do agree to extinguish on the back of this deed, that I have good right to sell and convey the same to the said Joseph C. Know all men by these presents that I Seth P. Carpenter of Milford in the County of Worcester and Commonwealth of Massachusetts, in consideration of thirty five hundred dollars paid by Hannah Gilmore of said Milford, the receipt whereof I do hereby acknowledge, do hereby give grant sell and convey unto the said Hannah Gilmore her heirs and assigns, a certain piece of land with the dwelling house thereon situated in said Milford on the Southwesterly side of Spring Street, and bounded, beginning at a stone post in the ground with a drill hole in the top, on the Southwesterly side of Spring Street four rods and twenty two links Northwisterly [sic] of a stone post [on the Southwesterly side of Spring Street sic for the whole phrase], at a corner of land of Leonard Hunt, thence Southeasterly on the Southwesterly side of Spring Street 4 rods 22 links to said stone post at the corner of said Hunt land; thence Southwesterly and bounding Southeasterly by land of said Hunt forty nine feet and six inches to a stone post with a drill hole in the top; thence Westerly and bounding Southwesterly by land of said Hunt and James H. Barker or his wife, four rods twenty two links and a half to a stone post with a hole in the top; thence Northeasterly in a straight line three rods and sixteen links to the place of beginning.

To have and to hold the aforegranted premises to the said Hannah Gilmore her heirs and assigns, to her and their use and behoof forever. And I do for myself my heirs executors and administrators, covenant with the said Hannah Gilmore her heirs and assigns, that I am lawfully seized in fee of the aforegranted premises; that they are free of all incumbrances; that I have good right to sell and convey the same to the said Hannah Gilmore, and that I will and my heirs shall warrant and defend the same premises to the said Hannah Gilmore her heirs and assigns forever, against the lawful claims and demands of all persons. And I, Diana Carpenter wife of the said Seth P. Carpenter, for the consideration aforesaid, do hereby release and quitclaim unto the said Hannah Gilmore her heirs and assigns, all the right title claim or demand which I may have in and unto the premises hereby conveyed, under or by virtue of the homestead exemption laws of the Commonwealth of Massachusetts, and also all right claim or possibility of dower in said premises.

Know all men by these presents that I Hannah Gilmore of Milford in the County of Worcester and Commonwealth of Massachusetts in consideration of seventeen hundred dollars paid by Seth P. Carpenter of said Milford, the receipt whereof I do hereby acknowledge, do hereby give grant sell and convey unto the said Seth P. Carpenter his heirs and assigns, a certain piece of land with the dwelling house thereon, situated in said Milford on the Southwesterly side of Spring Street, so called, and bounded Northeasterly by said Spring Street, Southeasterly by land of Leonard Hunt, Southwesterly by land of said Hunt & land of James H. Barker or his wife, & Northwesterly by land of the mortgagee. And being the same premises this day deeded by the said Carpenter to the said Gilmore, and this being a mortgage back for part of the consideration money.

To have and to hold the aforegranted premises to the said Carpenter his heirs and assigns, to his and their use and behoof forever. And I do for myself my heirs executors and administrators, covenant with the said Carpenter his heirs and assigns, that I am lawfully seized in fee of the aforegranted premises; that they are free of all incumbrances; that I have good right to sell and convey the same to the said Carpenter; and that I will and my heirs shall warrant and defend the same premises to the said Carpenter his heirs and assigns forever, against the lawful claims and demands of all persons.

Provided nevertheless, that if the said Hannah Gilmore her heirs executors or administrators, pay to the said Seth P. Carpenter his heirs executors administrators or assigns, the sum of seventeen hundred dollars and interest from date in manner as follows, to wit: three hundred dollars annually for the first five years from date, and the remainder in six years from date with seven per cent interest per annum, payable semi-annually from date, and untill such payment, keep the buildings on said premises constantly insured for the benefit of said mortgagee, to the amount of 3/4 of their value.

Then this deed, as also a certain note bearing date with these presents, given by the said Hannah Gilmore to the said Seth P. Carpenter to pay the sum with interest at the times aforesaid, shall be void; otherwise shall remain in full force. And provided also, that the mortgagor her heirs and assigns, may remain in possession of said premises, till condition broken.

In witness whereof, I the said Hannah Gilmore have hereunto set my hand and seal this first day of July in the year of our Lord one thousand eight hundred and seventy one.

Carpenter of Milford County of Worcester and State of Massachusetts the mortgagee named in a certain mortgage given by Hannah Gilmore to me the said Carpenter dated July 1st A.D. 1871 and recorded with Worcester County Deeds libro 851 folio 108 in consideration of two hundred dollars paid by Horace Walker of Milford aforesaid the receipt whereof is hereby acknowledged do hereby assign transfer and set over unto the said Horace Walker the said mortgage deed the real estate thereby conveyed and the note and claim thereby secured.

To have and to hold the same to the said Horace Walker and his heirs and assigns to their own use and behoof forever: subject nevertheless to the conditions therein contained and to redemption according to law.

Colburn of Newton, County of Middlesex, John Erskine of Boston, County of Suffolk and Charles H. Colburn of said Milford and all in the State of Massachusetts, and jointly doing business as partners under the name of Colburn, Erskine & Co. the receipt whereof is hereby acknowledged, do hereby remise, release, and forever quitclaim unto the said G. D. & C. H. Colburn and John Erskine, their heirs and assigns, all my right title and interest in and unto a certain tract of land situated in the central part of said Milford on the Easterly side of North Bow street, and bounded Northerly by land lately of Clement Colburn & Co.: Westerly by said North Bow street, Southerly by land of Charles H. Metcalf and Easterly by land of Greene brothers. It being the same tract of land described in a deed of right of way given by me to G. H. Clement, George D. Colburn and John Erskine Jr. dated May 22d A.D. 1858 and recorded with Worcester County Deeds, Book 596, Page 322.

To have and to hold the granted premises, with all the privileges and appurtenances thereto belonging, to the said George D. Colburn, C. H. Colburn & John Erskine and their heirs and assigns, to their own use and behoof forever. And I do hereby, for myself and my heirs, executors and administrators covenant with the said grantees and their heirs and assigns that the granted premises are free from all incumbrances made or suffered by me and that I will and my heirs, executors and administrators shall warrant and defend the same to the said grantees and their heirs and assigns forever against the lawful claims and demands of all persons claiming by, through, or under me the said grantor but against none other. And for the consideration aforesaid I, Diana Carpenter, wife of said Seth P. Carpenter do hereby release unto the said grantees and their heirs and assigns all right of or to both dower and homestead in the granted premises.

Carpenter her heirs and assigns all the right, title, interest, claim, and demand which we, or either of us, may, or can by any means have, in, and unto, a certain piece or tract of Meadow land containing about three and a half acres of land, more or less, and belonging to the estate of the late Seth P. Carpenter, late of said Milford, deceased, situated in said Milford on the Northerly side of Central Street, and formerly known as the Peck Meadow, and a part of which the Town of Milford leased to build a building now used to keep the Hose carriages, Hose and other things in, and also conveying to said Hannah M. Carpenter all the future accruing rents to be derived by, or from, said lease, with the right to collect, take, and use said rents, to, and for, her own use and behoof without being answerable in any way therefor, to us, or to any one for us, or either or any of us, forever. Said meadow land being all the meadow land owned by the said Seth P. Carpenter at the time of his decease on the Northerly side of said Central Street in said Milford.

To have and to hold the above released premises, to the said Hannah M. Carpenter her heirs and assigns, to her & their use and behoof, forever. And we the said grantors for ourselves and our heirs, executors and administrators, do covenant with the said Hannah M. Carpenter her heirs and assigns, that the premises are free from all incumbrances made or suffered by us, or either, or any of us, forever. And that we will and our heirs, executors, and administrators, shall warrant and defend the same to the said Hannah M. Carpenter her heirs and assigns forever, against the lawful claims and demands of all persons claiming by, through or under us but against none other.
